1. Acceptance of Terms

By creating an account or using the AgentRuby platform ("the platform"), you agree to these Terms and Conditions. If you do not agree, do not use the platform.

2. Description of the Service

AgentRuby is a caregiver training and education platform operated by Ruby Healthcare LLC. The platform provides voice-assisted and interactive training tools for caregivers supporting patients in home and post-discharge care settings.

3. Not Medical Advice

The platform does not provide medical advice, diagnosis, or treatment. Training content generated by or delivered through the platform — including AI-generated content — is for educational purposes only and may be incomplete or incorrect. Always consult a licensed healthcare provider for clinical decisions. In an emergency, call 911.

4. SMS Messaging Program

Program name: AgentRuby Authentication Description: We send one-time passcodes (OTPs) to verify your identity when you sign in to the platform. No marketing or promotional messages are sent via this program. Message frequency: Varies based on sign-in activity. Message and data rates may apply.

By providing your mobile phone number during account setup, you consent to receive one-time passcodes (OTPs) via SMS from AgentRuby for account activation and sign-in. Message and data rates may apply. You can opt out at any time by replying STOP to any message from us.

To opt out, reply STOP to any SMS from us. You will receive a confirmation and no further messages will be sent. Note that opting out will prevent receipt of verification codes and may limit your ability to sign in.

Supported carriers are not liable for delayed or undelivered messages.

5. Eligibility

You must be 18 years of age or older to use the platform. By using the platform, you represent that you meet this requirement.

6. Your Account

You are responsible for maintaining the security of your account. Notify us immediately at privacy@agentruby.ai if you believe your account has been compromised. We are not liable for losses resulting from unauthorized access to your account.

7. Not a HIPAA-Covered Service

AgentRuby is a caregiver training and education platform. Ruby Healthcare LLC is not a covered entity or business associate under HIPAA. Information entered into the platform is not treated as Protected Health Information under federal law.

You agree to use the platform only for its intended purpose — caregiver training and education. You may not:

Use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Limitation of Liability

To the fullest extent permitted by law, Ruby Healthcare LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability for any claim arising from use of the platform is limited to the amount you paid to use it (if any).

11. Changes to These Terms

We may update these Terms as the platform evolves. The "Last updated" date at the top of this page will reflect any changes. Continued use of the platform after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from use of the platform will be resolved in the courts of the State of California.
